On April 17, 2026, InfoBytes reported that the CFPB has submitted the a final rule titled “Small Business Lending Data Collection Under the Equal Credit Opportunity Act Reconsideration” (RIN 3170-AB40) to the OMB’s Office of Information and Regulatory Affairs for review under Executive Order 12866 (as amended).
In November 2025, the CFPB issued a proposed tule to revise certain provision of the 2023 final rule. If finalized, the revised rule would narrow the the scope by excluding merchant cash advances, agricultural lending, and small dollar loans. It would also raise the origination threshold from 100 to 1,000 covered credit transactions and lower the small business revenue definition from $5 million to $1 million. The number of data points that must be collected will be reduced and the compliance date would be extended to January 1, 2028.
