Fall 2018 CFPB Rulemaking Agenda

On October 17, 2018, the CFPB published its rulemaking agenda for the Fall of 2018.  This is the second rulemaking agenda under Acting Director Mick Mulvaney. The agenda indicates that the information is current as of August 30, 2018 and identifies items the  CFPB “reasonably anticipates having under consideration during the period from October 1, 2018, to September 30, 2019.”

The following rules are listed in the pre-rule stage:

  • Threshold Adjustment to Escrow Provision for HPMLs

  • Property Assessed Clean Energy Loans

  • Public Release of HMDA Data

The following rules are listed in the proposed Rule Stage:

  • The Expedited Funds Availability Act (Regulation CC)

  • Debt Collection Rule

  • Civil Penalty Inflation Adjustment Rule

  • Home Mortgage Disclosure Act (Regulation C)

  • Payday, Vehicle Title, and Certain High-Cost Installment Loans

  • Partial Exemptions from the Requirements of the Home Mortgage Disclosure Act under the Economic Growth, Regulatory Relief, and Consumer Protection Act (Regulation C)

The following rules are listed in the Final Rule Stage:

  • Disclosure of Records and Information

  • Summaries of Rights under the Fair Credit Reporting Act (Regulation V)

  • Technical Specifications for Submissions to the Prepaid Account Agreements Database
