President Signs Homebuyers Privacy Protection Act

On September 5, 2025, the President signed into law the “Homebuyers Privacy Protection Act”. The Act prohibits a credit reporting agency from providing a consumer’s credit report to another in connection with a residential mortgage transaction, except for certain circumstances.

The Homebuyers Privacy Protection Act aims to modernize the handling of sensitive information in the mortgage application process. When prospective homebuyers apply for mortgages, their personal information can inadvertently be sold to other lenders without their knowledge, a practice referred to as "trigger leads." This legislation introduces clear and sensible regulations to safeguard consumer privacy in this context. It has garnered strong bipartisan support, having passed out of the Financial Services Committee with a unanimous 46-0 vote on June 10, 2025, followed by a voice vote in the House of Representatives on June 23, 2025, and ultimately receiving unanimous consent in the Senate on August 2, 2025.
