Lending Advertising Requirements

Advertising loan products can be a very complicated ordeal for a number of reasons. First, there are several different rules and regulations that have requirements on what can be done with the advertising and marketing of loan products. This means that a financial institution has to be aware of all of the different potential rules and regulations that could apply, which are nearly a half dozen different rules. Secondly, the rules for lending advertisements are often very complicated. For example, Regulation Z has two completely different sections that govern the advertising of loans - one section for open-end credit and another for closed-end credit. And unfortunately, everything one must know about the advertising rules of Regulation Z aren’t found in just these two sections, as other sections (like the definition section in 1026.2 of Regulation Z) must also be understood as they (at least in part) also often apply.

Finally, advertising loan products can also be challenging because it is almost impossible for most marketing teams to create a lending advertisement or marketing piece without getting assistance from a compliance professional who really understands the rules for loan advertisements. The fifth and final video of the program reviews how a few rules, like UDAAP, RESPA Section 8, and even the Fair Housing Act apply to loan advertisements. The instructor includes a number of real life examples throughout the program to help attendees understand some of the common violations as it relates to lending advertising and marketing.

It is important to note that this program does not provide any checklists to use for marketing creation and review. This is done intentionally as the instructor believes it is essential to have a comprehensive understanding of the actual rules and regulations that apply to lending advertisements - rather than to use a checklist that may not encompass every compliance requirement that applies to lending advertisements. That said, this program does include a comprehensive manual that outlines many of the rules and regulations discussed in the program - meaning that the manual itself can be a reference tool to assist in the creation and/or review of lending advertisements.
