Part II Featured Topics: Section 1071, Regulation B & AML/CFT Program Reform
For each Quarterly Compliance Update, we take a deeper dive into timely regulatory developments that financial institutions need to understand and incorporate into their compliance planning. For our Summer 2026 program, we’re featuring three important topics: Section 1071, Regulation B, and AML/CFT Program Reform.
Our May 2026 Section 1071 Final Rule Update provides a practical overview of the CFPB’s significant revisions to the Small Business Lending Final Rule. We’ll explain what changed with the coverage/applicability from the 2023 final rule, as well as the reduction in data point collection, the updated implementation timelines, and what financial institutions should do now and consider going forward.
We’ll also take a closer look at the new Regulation B Final Rule, including the CFPB’s changes involving disparate impact, discouragement, and Special Purpose Credit Programs (SPCPs). We’ll focus on what actually changed and what banks and credit unions should consider for their fair lending, compliance, advertising, and SPCP practices going forward.
Finally, our BSA section covers FinCEN’s April 2026 AML/CFT Program Rule proposal, which would place a greater emphasis on effective, risk-based AML/CFT programs and directing resources toward higher-risk customers and activities. We’ll explain the key proposed changes, including updated expectations involving risk assessments, independent testing, program oversight, and FinCEN’s proposed role in certain significant supervisory and enforcement actions.
