New E.O. Ensures Artificial Intelligence Policy Framework

On December 11, 2025, President Donald J. Trump signed an Executive Order that aims “to protect American AI innovation from an inconsistent and costly compliance regime resulting from varying State laws.” The Order calls to create a national AI law that would take priority over state laws, allowing for more innovation.

The Executive Order establishes several directives aimed at promoting a unified national AI policy. Among others, it instructs the Attorney General to create an AI Litigation Task Force to challenge any unconstitutional or unlawful State AI laws that hinder innovation; it directs the Federal Trade Commission and Federal Communications Commission to act against State laws that may compel AI companies to mislead consumers, including assessing the legality of mandates involving diversity, equity, and inclusion (DEI) in AI models; and it calls for the establishment of a national legislative framework to supersede restrictive State AI laws.
