On August 17, 2026, the Treasury issued a proposed rule related to its implementation of section 3 of the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act. In particular, the Treasury is seeking comments on the proposed framework for the statutory prohibitions and limitations on payment stablecoin issuance, offer, and sale in the United States.
Beginning January 18, 2027, generally, payment stablecoin issuers will need an appropriate federal or state license to issue stablecoins in the United States, with additional restrictions applying to foreign-issued stablecoins. The proposed rule is intended to clarify when an issuer must obtain a GENIUS license and when digital asset service providers may offer or sell payment stablecoins to persons in the United States.
Comments on the proposed rule will be accepted until October 19, 2026.
