Treasury Seeks Comment on the GENIUS Act Implementation

On September 18, 2025, the Treasury has issued an Advance Notice of Proposed Rulemaking (ANPRM), seeking public comment related to Treasury’s implementation of the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act. 

The GENIUS Act, enacted on July 18, 2025, provides a comprehensive framework for the federal regulation of payment stablecoins.  The Act directs the Treasury to create rules that support innovation in payment stablecoins. These rules should protect consumers, reduce risks related to illegal finance, and address concerns about financial stability.

Comments from the public will help the Treasury on the potential regulations that may be promulgated by the agency, including regarding regulatory clarity, prohibitions on certain issuances and marketing, BSA/AML and sanctions obligations, the balance of state-level oversight with federal oversight, comparable foreign regulatory and supervisory regimes, and tax issues, among other things. Comments will be accepted until October 20, 2025.
